Dispute Resolution for Design Deficiencies.
If a dispute arises out of or relates to the policies or services agreed upon, the parties shall endeavor to settle the dispute first through direct discussions between the parties’ representatives. If the Parties are unable to agree on the nature or scope of the Corrective Work necessary to resolve the Design Deficiencies or whether the Corrective Work has been completed, then within ten (10) Business Days of initial complaint, Seller and Buyer shall agree to determine the nature and scope of the Corrective Work or whether the Corrective Work has been completed, as applicable. The seller will be granted one opportunity to make good with the buyer whether this is in the form of a revision or additional services provided. In the event that the Parties are unable to come to an agreement that is satisfactory to both parties, the seller may retain competed work, the buyer is able to request completed deliverables, and both parties are free of any additional liability or compensation addendums. The decision regarding the completed and corrective work shall be final and binding between both Parties and is NOT appealable or disputable.
